REUTERS/Lucy Nicholson/File Photo Acquire Licensing RightsOct 5 (Reuters) - Constellation Brands (STZ.N) raised its annual profit target on Thursday after higher prices and strong demand for its beers and spirits drove a sales and profit beat in the second quarter. Constellation also raised the annual sales forecast for its beer business. Constellation now expects fiscal 2024 comparable earnings per share between $12.00 and $12.20, as against its previous forecast of profit between $11.70 and $12.00 per share.

Its quarterly net sales rose 3%, to $1.04 billion, compared with analysts' average estimate of $1.05 billion. Raindrops hang on a sign for Wall Street outside the New York Stock Exchange in Manhattan in New York City, New York, U.S., October 26, 2020. Stubborn inflation readings from Europe on Wednesday and hesitation around this week's China market rebound suggested the coast was far from clear despite worldwide stock and bond market rally in the previous session. Ebbing consumer confidence in August reinforced the message of slowing activity, however, and The Conference Board's so-called labor market differential, derived from respondents' views on whether jobs are plentiful or hard to get, narrowed by almost six points to 26.2% - its lowest since April 2021. China's stock markets also stalled after a two-day rally, with U.S. Commerce Secretary Gina Raimondo claiming on her three-day visit to the country that many U.S. firms now see China as "un-investable". But it seemed to draw a line under the stock market this week with a series of supports and the prospect of further cuts in lending, deposit and mortgage rates.

Jack Daniel's maker Brown-Forman on Wednesday fell short of Wall Street expectations for its first quarter of fiscal 2024, plagued by lagging whiskey sales, supply challenges and a significant inventory rebuild. Net sales for whiskey products decreased by 1%, led by the brands Woodford Reserve and Gentleman Jack. Sales for Jack Daniel's Tennessee Whiskey were flat, the company said, due to lower distributor inventories across the United States. Its New Mix RTD beverages delivered strong net sales growth of 52%, while its el Jimador tequila brand saw net sales grow by 27%. Reported advertising expense grew 19%, driven by the launch of its Jack Daniel's & Coca-Cola RTD item, increased investment in Jack Daniel's Tennessee Whiskey, and acquisitions.

As August is known to be, it's been a rough month-to-date for all three of those stock market benchmarks so far. This past week, the overall market was oversold, according to Jim Cramer's trusted S & P Oscillator. After Friday's strong finish, we'll see if the market's oversold condition abates as two major themes play out in the week ahead: Earnings from two Club names — Salesforce (CRM) and Broadcom (AVGO) — and key economic reports ahead of September's Fed meeting. Outside of the labor market and inflation, we'll also get a look at the housing market with the pending home sales on Wednesday. As we heard from fellow Club name Palo Alto Networks (PANW) last week, companies are growing more cautious and more closely scrutinizing large sales deals.

It's time to buy spirits stock Brown-Forman , according to Morgan Stanley. Morgan Stanley's previous underweight call was based on limited visibility around gross margin recovery, the company's full valuation and slower U.S. spirits industry growth. However, Serotta now expects meaningful upside for the stock. Agave, which is used to produce tequila, has been a disproportionate headwind to the company's general margins over the last several years, Serotta said. Serotta also said that, while the company's absolute valuation is "rarely cheap," its relative valuation appears compelling compared to its peers Monster Beverage and Constellation Brands .

The decision is likely to force companies to toe a more careful line when making commercial products that mimic other brands for the sake of parody, legal experts said. The Rogers test is "not appropriate when the accused infringer has used a trademark to designate the source of its own goods - in other words, has used a trademark as a trademark," Justice Elena Kagan wrote. Other experts said the decision leaves space for the First Amendment to apply to parody products. "The underlying numbers in the report today show that the Fed can probably feel comfortable with maybe one more rate hike, and then pausing." Or, at least those concerns were true until Friday's explosive rally, when more than six New York Stock Exchange issues rose for every one that fell, and all 11 sectors in the S & P 500 gained. Friday's advance carried the S & P 500 to its highest since Aug. 18, 2022, when the benchmark closed at 4,283.74. Another favorable straw in the wind may simply be the fact that the 11.2% rally in the S & P 500, just since the mid-March lows accompanying the failure of Silicon Valley Bank, is so hated and mistrusted. Jack Daniel’s Tangles With Dog Toy at Supreme Court

A bottle of Jack Daniel’s Tennessee Whiskey next to a ‘Bad Spaniels’ dog toy. WASHINGTON—A trademark case put the Supreme Court’s humor to the test Wednesday, as the justices heard a distillery’s plea to stop a novelty company from selling a dog toy shaped like a bottle of Jack Daniel’s. Phoenix-based VIP Products LLC markets squeaky toys that mimic beverage bottles, including a 10-inch-tall item with a black label reading “Bad Spaniels: The Old No. Among those unamused was Brown-Forman Corp.’s Jack Daniel’s Properties unit, which produces Jack Daniel’s Old No. 7 Brand Tennessee Sour Mash Whiskey.
WASHINGTON, March 22 (Reuters) - The U.S. Supreme Court on Wednesday is set to hear a trademark clash between Jack Daniel's and a dog accessory company behind a parody chew toy resembling the distiller's widely recognized black-label whiskey bottle. The dispute pits the whiskey brand's trademark rights against legal protections for creative expression - in this case a send-up by Phoenix-based VIP Products LLC of Jack Daniel's Old No. A 2,300-strong group of authors took the opposite view, saying a win for Jack Daniel's could lead to a "catastrophic chilling effect" over worries that creative expression might spark litigation. The 9th Circuit said the Bad Spaniels toy was an "expressive work" and thus potentially shielded under the First Amendment from Jack Daniel's trademark infringement claim. President Joe Biden's administration supports Jack Daniel's appeal.
